AVCA adds six members to Legal & Regulatory Committee

The African Private Equity & Venture Capital Association (AVCA) has added six new members to its Legal & Regulatory Committee, which is co-chaired by Mara Topping, partner at White & Case and Solomon Wifa, partner at O’Melveny and Myers.

The industry members joining the committee include: Karim S. Anjarwalla, managing partner, Africa Legal Network; Geoffrey Burgess, partner, Debevoise & Plimpton; Patrick Deasy, partner, King & Wood Mallesons SJ Berwin; Arnaud Duhamel, partner, Gide Loyrette Nouel; Kem Inhenacho, partner, Clifford Chance; and Lele Modise, head of private equity Africa, Bowman Gilfillan.

Topping says: “As private investment opportunities in Africa are increasingly sought out by global investors, AVCA plays a catalysing, momentum-building role in enabling them to make informed business decisions. The Legal & Regulatory Committee enhances the ways in which AVCA can assist its members to understand the legal and regulatory environments of each African nation – for example, in 2013, we launched a series of private equity country guides that covered Ghana, Nigeria, Zimbabwe, Mauritius, Morocco, Tunisia and South Africa. These guides provide foreign investors and managers in Africa with country-specific information and address common investor considerations including formation of business entities, corporate governance, creditor protections, exit options, taxation, remedial action, the regulatory environment and intellectual property protections.”

Wifa adds: “We particularly welcome the addition of this extraordinary wealth of private equity legal expertise to the committee, which will further allow us to support AVCA in meeting the requests for information and regulatory updates from its ever-increasing member base. In the near future, we will not only be continuing to extend the private equity country guides series to include Francophone Africa, but will also be developing proprietary private equity training modules and legal document templates for AVCA’s member firms, which will add to the development of collective best practice amongst new and experienced investors in Africa.”
